The Helensburgh Waterfront Development Contract will deliver a new-build 25m, 6 lane swimming pool and leisure facility, with associated car park/ public realm and flood defences. The Helensburgh Waterfront Development Project will deliver a new-build 25m, 6 lane swimming pool and leisure facility; Flood protection works to the site perimeter; 250 space car park; Public realm comprising perimeter walkway and flexible open space; development of 28,000ft retail opportunity; skate and cycle facilities; consideration of location of existing fairground business. This Procurement will be conducted through the use of the Restricted Procedure. All queries about this procurement must be made via the PCS- Tender messaging system.
Bidders will be assessed against their responses to Part III (Exclusion Grounds) and Part IV (Selection Criteria) of the ESPD (Scotland). For Part IV (Selection Criteria) the following questions will be used to limit candidates not otherwise excluded by the Exclusion Criteria.

Section C of Part IV of the ESPD (Scotland) will be scored in the following way:

2 — Acceptable. Response is relevant and acceptable. The response demonstrates broad previous experience, knowledge and skills/capacity/capability but may lack in some aspects of similarity e.g. previous experience, knowledge or skills may not be of a similar nature.

4B.1: Bidders will be required to have an average ‘general’ yearly turnover of GBP1,000,000 for the last 2 years.
As evidence for the ESPD (Scotland) question 4B.1, the Procurement Officer may ask for annual accounts from the bidder.
4B.3: Where turnover information is not available for the time period requested, the bidder will be required to state the date which they were set up or started trading.
4B.5: It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below:
Employer's (Compulsory) Liability Insurance = 5 000 000 GBP.
Public Liability Insurance = 5 000 000 GBP.
Professional Indemnity Insurance = 2 000 000 GBP.

Copies of tender documents are attached to this contract notice for the information. Bidders may choose to review these and formulate potential responses however there is no requirement to submit the tender documents in response to this notice. At this stage bidders are only required to complete the ESPD responses in accordance with the instructions to tenderers

Health and Safety. In respect of health and safety, the Consultant shall be required in the Contract to comply with all relevant legislation and industry best practice standards as apply to the subject matter of the contract.
Construction (Design and Management) Regulations 2015 (CDM Regulations. The Consultant shall undertake the role of Principal Designer and shall fulfil all required responsibilities in accordance with the CDM Regulations. Argyll and Bute Council will fulfil the duties and responsibilities of Client under the CDM Regulations for the Contract.
Contractual Securities. Contractual Securities including but not limited to one or more of a)Parent Company Guarantee may be required. b)Collateral Warranty. c)or other such Contractual Securities may be required from the parent company (or companies) of Single Tenderer, or from the parent company of each member of a Group of Tenderer and such requirements will be identified in the final ITT documents.

A summary of the expected community benefits has been provided as follows:
